Before making a booking, please take a moment to read the following Terms and Conditions carefully. If you need any clarification, feel free to contact us by phone or email.


Tour Cancellations or Date Changes

If you cancel your booking less than 48 hours before the scheduled departure time, the full tour cost will be charged as a cancellation fee. Some tours may need to be changed or cancelled due to weather, tide conditions, or other unexpected situations.

In the rare situation that Destiny Blue Charters must cancel a tour, guests will be offered an alternative travel date, the option to book another available experience, or receive a full refund. We also reserve the right to cancel a booking if pricing has been incorrectly displayed.


Tour Cancellations by the Operator

Although uncommon, tours may occasionally be cancelled due to weather conditions or unforeseen circumstances. If this occurs, guests will have the choice of a full refund or rescheduling to another available date.


Terms and Conditions


1. Application of Terms

These Terms and Conditions apply to all services provided by Destiny Blue Charters Pty Ltd (“Destiny Blue Charters”) to the customer (“Customer”).

These terms take priority over any other conditions unless another written agreement specifically states otherwise. If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

By making a booking, the Customer confirms that all agreements, promises, and understandings related to the booking are contained within this document.

Where laws such as the Competition and Consumer Act 2010 apply and cannot be excluded, Destiny Blue Charters will comply with those legal obligations. If liability cannot legally be excluded, our responsibility will be limited to providing a refund for the relevant services at our discretion.

Customers confirm they have had the opportunity to review these terms before accepting them and agree that they are fair and reasonable for both parties.

To the maximum extent permitted by law, Destiny Blue Charters’ total liability for any claim relating to the services or this agreement will not exceed the amount paid by the Customer for the tour.


2. Payment and Cancellation Policy

When a Customer books a tour with Destiny Blue Charters, they are reserving a place on the selected tour for themselves and any passengers included in the booking.

Full payment for the tour is required at the time of booking.

All listed prices exclude GST. Where GST applies, it will be added to the total price as required by law.

If a Customer cancels their booking more than 48 hours before the scheduled tour date, a full refund will be issued.

If cancellation occurs less than 48 hours before the tour, the full booking fee will be charged because the reserved seat may not be able to be resold.

Destiny Blue Charters may cancel a booking at any time due to weather conditions, safety concerns, transport availability, force majeure, or other circumstances outside of our control. If this occurs, the Customer will receive a full refund. This refund represents the full extent of our responsibility for the cancellation.

Tours may also be cancelled if the required minimum number of participants is not reached.

Any environmental management charges paid in advance for the Great Barrier Reef Marine Park Authority will be refunded if a customer does not attend the tour.


3. Passenger Conditions

When making a booking, the Customer may include additional passengers by purchasing tickets on their behalf.

By attending a tour or participating in any part of the experience, both the Customer and all passengers agree to these Terms and Conditions.

The Customer is responsible for ensuring that all passengers included in their booking have read and agreed to these terms before attending the tour.

Destiny Blue Charters reserves the right to refuse participation or boarding to any Customer or passenger if, in our judgment, they:

  • Are intoxicated or behaving in a threatening or abusive manner
     
  • Fail to follow reasonable instructions given by crew members or tour staff
     
  • Violate these Terms and Conditions
     
  • Pose a safety risk to themselves or others
     

Tour schedules, prices, or vehicles/vessels used may change if necessary and without prior notice.

All passengers must follow applicable laws, regulations, and safety instructions during the tour.


4. Liability and Responsibility

By participating in our tours, the Customer agrees that Destiny Blue Charters Pty Ltd, including its staff, owners, and operators, will not be held responsible for:

  • Personal injury or death
  • Loss or damage to personal belongings
  • Travel disruptions or related costs
     

This applies to activities including boarding, transport, water activities, tours, and disembarking, except in cases where loss or damage is directly caused by negligence from Destiny Blue Charters.

The Customer agrees to compensate and protect Destiny Blue Charters against any claims, damages, or expenses arising from a breach of these Terms and Conditions or from claims made by passengers included in their booking.


5. Health, Safety and Participation

Destiny Blue Charters reserves the right to refuse participation for infants, young children, or passengers using wheelchairs on certain tours where safety risks may exist.

Some environments or tour conditions may make it impractical to ensure safety for these passengers on group tours.

These limitations comply with applicable Australian legislation including the Disability Discrimination Act 1992, Work Health and Safety Act 2011, Anti-Discrimination Act 1991, and Age Discrimination Act 2004.

In some cases, private charter options may be available to accommodate passengers with specific accessibility needs.


6. General Conditions

This agreement is governed by the laws of Queensland, Australia, and any legal matters will fall under the jurisdiction of Queensland courts.

If Destiny Blue Charters chooses not to enforce a particular part of these Terms and Conditions at any time, this does not mean we waive the right to enforce it later.

Acceptance of these Terms and Conditions forms a legally binding agreement, including acceptance through electronic communication or online booking systems.
